In a recent Forbes report, the latest legal drama lays out that Bungie's decision to vault substantial game content has unintentionally complicated its defense against plagiarism allegations. The original lawsuit centers around claims from an individual who believes Bungie copied story elements from his earlier online writings.
Bungie, on the other hand, has pit their hopes in a defense that relies heavily on demonstrating that Destiny 2's story content, including the Red War and Curse of Osiris expansions, are distinctly original. However, since Bungie removed and archived significant portions of this content with the Beyond Light expansion, they can't present any real in-game examples to the court.
Instead, Bungie submitted lore videos and Wikipedia summaries as evidence. The judge rejected this approach, insisting on direct game evidence. The challenge for Bungie now is proving their originality without accessible game content, which means this is a Destiny 2 battle that may just barely take longer than one of their raids.
