A New York District Court has found Florida resident Jhonny Perez guilty of copyright infringement for developing "Elusive", a software exploit tool used in Grand Theft Auto Online. The Elusive program was sold in packages anywhere from $10-$30. The finding comes with a hefty price tag too. Perez ows Take-Two $150,000 plus $70,000 in attorney's fees. The defendant chose to avoid the legal proceeding which led to the court finding in Take-Two's favor.
“Take-Two has been irreparably harmed by Mr. Perez’s infringing conduct and will continue to be harmed unless enjoined,” US District Court Judge Kevin Castel writes in his order.
“Mr. Perez’s Elusive program creates new features and elements in Grand Theft Auto which can be used to harm legitimate players, causing Take-Two to lose control over its carefully balanced plan for how its video game is designed to be played,” he writes.
In addition to the financial penalty against Perez, the court also placed an injunction on Elusive and any further sales.
