LotRO's audiance is quite a bit different from WAR and AoC. PvP centric games are probably not going to put a huge dent in LotRO's subscribers.
This is true. I don't think anyone goes to LOTRO for the pvp.

After AOC came out I didn't see much change in population at all. If anything I think it may have gone up. Warhammer will be the same thing with LOTRO. A few will leave but those will be replaced by people who return from trying WAR and will probably pick up some extras that were thinking about LOTRO.
AOC and WAR are completely different styles from LOTRO.

You can take back video games in the U.S. The stores just try to make it a real pain in the ass but if you get the BBB involved they sure change their tune.
Hell, I even got a refund from a movie theatre because I thought a movie sucked and sat 3/4 of the way through it.
We are pretty well safeguarded in the states if you get the proper people involved. Like I said though most stores and businesses try to make it a big hassle.

GameStop/EB wont carry more than 5 copies of anything not WoW, and even then its getting hard to see copies of any PC games in the stores seeing as they have them limited to this tiny ass rack in the darkest corner of the shop.
Target still has a few copies though, and I am even suprised Walmart would carry the game (though the 2 really close to me dont carry any PC games save for Deer Hunter...) due to the whole Mature rating.
Its all pretty much the way the games are distributed. They will have different expectations for different regions, sometimes they figure wrong so areas get shorted while others have a glut.

I voted 25% because they have sold 1 million copies so far, last I heard. That would still give them 250,000 worldwide which sure ain't bad.
