There's already a Warhammer 40K MMO being made by some small dev studio I've never heard of before: www.vigilgames.com/games_40k.php No affiliation with SOE as far as I know.

I would warn you, it isn't really worth the time to do so, even if you have the game still installed. SWG is currently the worst MMO on the market, and it doesn't look like anything is going to dethrone it any time soon.
