Did I just read it right that you got an inspector or Judge to go to NPCube on June 9, 2006 and that you guys did in fact found what was you are looking for, and that it is proof they are using your IP?

Hey, don't knock Ginsu Knives. I used one to cut down and steal a Christmas tree once ( long story ).

Picture, if you will, a 16 year old Zorvan. Now this 16 year old Zorvan lives with his grandmother at the time, and times are tough. Young Zorvan works at the local Wendy's, but it's basically enough to supplement what his grandmother gets from social security to pay for necessities.

So, it's Christmas time, and Zorvans' grandmother really wants a tree but can't afford it. They have decorations from years past, so that's not a problem. A tree to hang them on is.

Now, young Zorvan only has a little moped that he uses to go to work ( having taken the High School Equivalency Test to graduate early from school ), hardly fit for carrying a tree. Also very noisy when not wanting attention. So, our 16 year old Zorvan walks 3 blocks at 2 a.m. on a cold morning a few days before Christmas to a little commercial tree farm, armed with a Ginsu knife ( the big long one with the prongs on the end and the big serrations on the blade ).

He goes into the middle of the lot where he can't be seen by any passing motorist ( mainly worried about police ), and chooses a nice 5 foot  pine tree. He cuts as fast as possible through the trunk, taking about 10-15 minutes. He then heads home, walking down the sidewalk at around 2:30 a.m., placing the tree on the grass strip on the edge of the sidewalk and squatting behind it whenever he sees headlights coming.

At around 3 a.m., our young Zorvan carries the tree into their house, and smiles when he sees his grandmothers' face light up brighter than that tree ever would.

The Court denies summary judgment against NPCube in the case brought by VWORLD for counterfeiting of its video sequences:

- it rules that there is indeed an unlawful use of VWORLD's video sequences, sequences with the VWorldTerrain logo on and sequences from which it has been removed, with the goal of presenting and promoting the Dark and Light MMORPG through a TV report made by the Games TV channel, a report which has been broadcasted on other Internet websites
-  it rules that the evidence brought forward by VWORLD is insufficient for summary judgment to be granted against NPCube
- it rules that three companies have a vested interest in the promotion of the Dark and Light MMORPG: the French company NPCube, developer of Dark and Light, the Chinese company SnailGame, its partner , and the Mauritian company Farlan Entertainment, publisher of Dark and Light.

Consequently the decision on this pirating of video sequences will be taken upon examination of the substance of the case brought by VWORLD before the Paris Court against NPCube, Farlan and M. César Jacquet for software counterfeit, non-respect of the right to credit and paternity, and finally unfair competition and parasitism: the date of final hearing being scheduled on October 2nd, 2008.

In brief, the Judge has ruled that VWORLD's video sequences were used illegally (copyright infringement) to serve the promotion of DnL,  granted. 

BUT that the motion for summary judgment is rejected as it has not been made totally undeniable that NPCube is liable for this pirating. So *somebody* pirated 2005 images from VWORLD in order to promote Dark and Light in 2006 and 2007 but it is not clear that it is NPCube's doing. 

The magic power of partnerships (Who's got the Baby, anyone? ).  

So now Farlan/NPcube are trying to let Snailgames take the heat, huh? I bet SG just loves their deal more and more.

Aye, and a little note passed off to the corporate headquarters of Voyage Century might be making its way into their offices very shortly. The EURO affiliates should be getting their news shortly thereafter. Snailgames may have alot of explaining to do. May be fine in China , but in US/EURO, stolen property is a HUGE misstep.

So they have officially ensnared Snailgames in the fray in the legal courts.
