Really????? I nor anyone else ever bought a EU client, I bought an EU account. The game has NEVER been for sale anywhere in any form.

What I downloaded was a free client off a torrent and I am sure that the US version is the same.

JTBanker, you didn't buy a client, nor did you buy an account.  What you bought was a license to play the game using your account (which could be created for free, like mine was months before I subscribed) and the client (which I downloaded for free via torrents prior to the launch).  That license (at least the copy I have after I first patched up the game on April 30th, when I subscribed) states:

"
1. Limited License to the World. Your participation in the Game and the World are subject to your ongoing agreement to and compliance with these TOS. Aventurine grants you a non exclusive, non transferable, revocable license to the Game and the World, subject to these TOS and the EULA. You may only use the Game and the World for your entertainment. Any commercial uses of the Game or the World by you is strictly prohibited.

"

This is common verbiage.  Gamers don't buy "software" or "games", they buy the license to use or play them.  Frankly, I think the wording used by Tasos regarding the "American Darkfall client" is just poorly phrased.  Additionally, the EULA states:

5. Darkfall Account. In order to play the Game in the World each player must establish an Account with the Darkfall online system. When creating an account you will provide Aventurine with personal and financial information as well as the Authentication Key provided to you when you purchased the Game. You must provide accurate information to Aventurine and update that information promptly after it changes. Once you establish your account you will select a player name and set up a password for your account. Do not share your player name or password with anyone else. You are responsible for maintaining the confidentiality of your account player name or password, and you will be responsible for all uses of your account player name or password, whether you authorize its use or not. Notice, nowhere in the EULA does it state you own the client, your character or even your account.  You simply paid for the license to play the game in Aventurine's virtual world.

All that being said, it is interesting that the EULA doesn't contain any references to AudioVisual or their right to distribute the game and/or manage player accounts/billing.  Additionally, the EULA doesn't reference the game client or world only being licensed for The only company references are to Aventurine, themsselves.  Why is this interesting?  Because the publisher should be included in the EULA. Case in point, there are separate regional EULAs for each publisher of LotRO:

If the Aventurine is self-publishing in North America and they don't have a separate EULA for the game, then signs point to them being greedy and underhanded, in which case they'll alienate even more customers.

Let's not start getting into all the BS that is in a EULA which has NEVER been enforced in any court anywhere that anyone can provide a citation for. There have been copyright violations which people think are EULA or TOS violations but they are a totally different animal.

Suffice to say, this whole NA server thing sounds fishy and stinks to high heaven being only 6 days away with no known NA publisher.

 Have they increased server capacity? I'm just curious as to how ( as stated previously ) that there are 17k active players. I thought the bar per server was set at 10k. I point further to your above post that they intentionally kept the game small. If the game is meant to be 10k players per server and they are currently at 17k on the EU server that would be an overload, would it not? That said ... why is the online store still allowing people to purchase the game, if there is a cap and we are above that cap?

I am sure there is an acceptable, logical, and demonstrated reason for this seemingly contorted jump in rationale.


 

The op attests that he has seen logs showing 17,000.  Is this number concurrent subs, or total active subs?  Perhaps the op, or someone else, is able to elaborate upon this topic in a reasonable, logical fashion, and answer our questions?


 

Ok, so he posts above that he is NOT associated with Av but he has SEEN logs showing 17K subs? Interesting never knew that private companies made that type of info available to any old gamer.

Guess I should write Sony and Blizz and ask to see their official logs since I am sure it is common place to just show them to anyone. Oh forgot, Av is a special (as in special ed) company that does everything differently then all other companies in any field of endeavor.

So Signus who should we email at Av to get to see those "official" logs? Are they kept on the same "official" log server that showed that Ed Zit only played a couple of hours? ROFLMAO

Who the hell wants to play on a server with 2 or 3K players (if even that many)? You need players to have a PvP game and with the population as low as it already is, splitting servers sounds like the death knell.

Even our old hated friend SoE combined servers when they got to a low number, hell Av is splitting it to get to a lower population...BOGGLE!!!!!

While this is purely an academic debate, I have to agree with Holgranth's point.

Using WoW as a recognizable example...A person can play without purchasing any expansion packs. They will have fewer gaming options then those who do have the expansions, but they can play none-the-less.

That same person cannot, however, play unless their client is patched up to the current version. This is independant of the optional expansion packs and is mandatory in order to play the game.

I think that's a pretty good distinction between the two.

Actaully it was looking at the three WoW boxes sitting at the back of my closet (On top of the WAR box) that made me realise HEY! I don't need all three to play WoW just the first box and all the patches.................waitaminuet!
 


 

Totally correct.

For example you only needed the original EQ to play on the progression server a couple years ago but you HAD to have the latest patches or the client could not even login to the server. I had one EQ account that was still Vanilla EQ after all these years and one that was full boat with all expansions and guess what they both f'n worked.

Your distinction as to the difference is spot on.

I really don't care what they call it, since they have been full of lies for over 9 years so who really gives a flying F***. The game won't bring back enough people or sucker in enough new ones to keep alive.

They have shot their proverbial wad and from here on it is just eating popcorn and watching it die with a whimper. Should be interesting to see if they can last longer the Deceit-and-Lie did but I wouldn't make book on it.

Agree that the charge back will have more immediate effect. I for one want companies like this to suffer lasting effects so that others don't try the same shit again. Like the effects that the French courts dropped on Farcelan for the theft of intelectual property that was used in Deceit-n-Lie.

Should be interesting to see the patch / expansion tomorrow. In fact don't you European players have it already for your EU client? After all it is the 6th over there already and we don't have an NA client available yet so we can't have the expansion yet. ROFLMAO..........

An EULA is a contract.

A contract, for it to be legal, cannot contain clauses that require a party of the contract to renage  their basic legal rights.

 

this is why SWG were forced to offer refunds for the exapansion the released 5 days before the nge appeared.

For instance we employ 36 people and in each and every contract it states that job duties could change at anytime. And it is perfectly legal. In England we use a company called First Buisness that check each contract before issuing them.

There is no expansion, it is just a delayed patch that is a bit larger then the ones the were rolling out at first and they are calling it an "expansion".

Yes and I can't remember the name of the author that holds the rights to Darkfall. I do remember he is a big name author though.

Bottom line, still no word about the "publisher" if such an entity actually exists.

Gee sure would hate to see poor Av get slapped with a copyright infringement lawsuit when they try to sell their game in the US, but I am sure that their "publisher" has taken care of all the licensing requirements in the last few weeks since they were informed that they are the "publisher".

Can't wait to see the new web pages also that don't have any bait and switch or false advertising on them. To think that finally after over 7 months they will finally have the time to make a 5 minute change to their website. Damn they sure have been busy with all the improvements and preparing for the NA launch and the first expansion pack.

His complaint sounds very much like what I posted to the FBI's Internet Crime Complaint Center (IC3.gov) against Av, and I suggest others follow the same path.

Lets see how well they hold together when Interpol and other agencies start anal probing them and turning over the rocks to see what other slime is living under them.

I'm a pretty forgiving customer because I have never played a game like Darkfall. It has given me a completely different experience than all the other games that I have played. After experiencing DFO, I wouldn't ever want to play another game with target selection and button mashing. Yes you can say DFO is button mashing but it is a different way. I agree that AV is a piss shit company that has bad customer service but you never know what reasons they have for the bad service and updates. I am not going to quit just because of the company because I like the game.
This forum section is getting pretty boring. Everyone just talks about everything else besides the game since most of you don't like DFO. It would be entertaining if people actually shared their experiences in game with others.


 

Ok, I'll share my experiences in game:

Pick target, mash left mouse button until target or I are dead. Pick up loot piece by piece, get ganked while doing it. Rinse, wash , repeat.

That pretty much describes the game except for the click to harvest, rinse, wash, repeat of the advanced crafting.

I believe that it is total BS spin. They are using the same infrastructure as the EU server, same server farm provider, same client, probably the same CC clearing company. Even if the CC clearing company is different it is only a % or so that they will charge Av for processing the cards.

Nope makes no sense to anyone with half a logical brain cell except to call it what it is: a money grab / scam that was planned from the beginning. I have turned them in to the IC3 for investigation and suggest others do the same. Let the FBI and Interpol look into their practices and dealings. I am sure that they have nothing to hide and are totally above board.
