January 2008- [NPCube - Other cases]
Mid 2005, NPCube, represented by its Managing Director Mr César Jacquet, had lodged a complaint against one of its salaried employees, and had associated in the subsequent court action with the public prosecutor. The employee was charged  with theft, notably to the benefit of VWORLD. Consequently, he had been indicted and the case had been brought before the Magistrates' Court of Saint-Denis, Reunion Island. 

NPCube has been non-suited, a first time on April 3rd, 2007, a second time on appeal on July 23rd, 2007 and a third time before the Court of Cassation on January 8th, 2008. Mr Christophe Nazaret and Mr Laurent Paret, NPCube's associate members, had testified against their ex-salaried employee, who had been dismissed earlier in 2005.

In its allegations, NPCube had implied that VWORLD had been pirating its work via the Internet and had been stealing confidential data from NPCube through two of NPCube's employees. VWORLD did not discover such serious accusations had been levelled by NPCube against VWORLD (as early as 2005) until April 2007, when the first non-suit decision was delivered by the Court of Saint-Denis, Reunion Island.

Separately, NPCube has been convicted on last December 3rd, 2007 by the Labor Relations Board of Reunion Island, for moral harassment and dismissal without sufficient grounds or justified motive of one of its ex-salaried employee, who had also been dismissed in 2005.

Let me get this straight. Back in '05 Farlan/NPC accused an ex employee of stealing and such right? The employee however was found innocent, or no grounds, but Farlan/NPC was in turn convicted of harassment and what I would imagine is the same as wrongful termination and other bs towards this employee as of Dec '07....right?

January 17, 2008- [NPCube - Commercial Court of Clermont-Ferrand]
The plaintiff NPCube hasn't filed any submissions on the substance of the case in reply to the submissions in reply filed by the defense of VWORLD on last November 9th, 2007. The final hearing takes place at the Commercial Court of Clermont-Ferrand and the Court's decision is to be rendered on March 13th, 2008.

It means that NPCube chose not to reply to VWORLD's rebuttal in reply to their accusations, since they considered our submissions in reply were "off the point". 

So the final hearing has taken place. It is now up to the Court to render its decision on March 13th, based on the elements provided by both parties.
