 The following is an except from  an email reply before I started my tirade against SOE, the response is from the SVP and General Counsel of Sony Online Entertainment Inc.

 “The Star Wars Galaxies "Terms of Use" (to which you (i) agreed when you installed the game and (ii) agree every time you launch the game) provides, in pertinent part:

"6. We may terminate this Agreement and/or suspend your Account immediately and without notice: . . . (iv) if you violate any of the player rules of conduct located at the Game Site or The Station (as defined below in Paragraph 9) rules of conduct located at www.station.sony.com/en/termsofservice.jsp (either of which we may amend or supplement from time to time, in our discretion), or (v) if you engage in game play, chat or any player activity whatsoever which we, in our discretion, determine is inappropriate and/or in violation of the spirit of the Game. If we terminate this Agreement or suspend your Account under these circumstances, you will lose access to your Account for the duration of the suspension and/or the balance of any prepaid period without any refund."

The Station Terms of Service prohibits, among other things, making any board post that is ". . .  threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, that may be invasive of another's right of privacy or publicity, hateful, racially, ethnically or otherwise objectionable."” End quote

 This email was a the follow-up to a telephone conversation to the head of legal department at SOE back at the end of February .Please keep in mind that yes, I did have lot of fun extending my in-game role-playing efforts on the SWG forums but I never did anything in-game that would warrant a game ban like I received in fact it was explained that my game ban was for forum misuse only , a misuse that has be duplicated by many others, then and since with little to no consequences. I have received two suspension to my forum use in my past but no game suspensions ,there was no mentioning that my game use was in jeopardy  - why? Because this was a rule change (ie. either of which we may amend or supplement from time to time, in our discretion) in the ever changing End user license agreement AKA EULA . Since the EULA can be changed at anytime by SOE and if you do not read the changed document when you sign on to the game ,which is a legal signature as mentioned in the document you have agree to the change. Such a manipulation of a document is a little bit sneaky. Then the implementation of the new rule or as SOE like to call it a “policy” without warning was the shock to me.

 Since My telephone conservation with SOE legal guy I was able to ascertain one important thing . He knew nothing about the exact reasons , point by point why my accounts were severely sanctioned.

In fact, he spoke in generalities despite that I warn him that I was calling by email 4 day earlier and when I announced myself to him I gave him a chance to reschedule the call to better prepare himself but instead he optioned to go with the very general information in front of him and proceed with siding with his co-workers decisions.

 It been 6 months that I was forced to enjoy the Number #1 MMORPG in the USA, made in the USA, which is World of Warcraft. I have also enjoyed punching at my former MMORPG hosts, SOE as they richly deserve.

I want to thank all who have tolerated my pronounces in these forums

But it comes time to take it right to the origin of the problem,

SOE and its business relation with me as a customer. After long consideration and mulling over the fact that I have business ties with another division of Sony. I have decided to break one day from my family vacation in San Diego the first week of August and visit The courts of San Diego and for a small fee ( see below)

Small Claims

  Filing a small claims action , if 12 or less claims filed within previous 12 months $22.00 ( a bargain to get SOE attention)

 I can perhaps get some real answers and my friend at SOE legal will have to finally become familiar with the particulates of my case instead of going on the generalities. Please note that this would just be a filing and I would have to also pay a nominal fee for the court clerk to send a registered letter to my former hosts. It will take awhile to get a court date and thank god I have some frequent flyer miles for a quick turn around court visit.  Whether I prevail legally or not is not my main concern – my concern is answers although I plan to request the maximum in monetary damages to make sure SOE takes it as serious as I plan to. Oh for those who are concern , I do have legal consul and some of those monetary damages would go to them if I win but I have already pay a set fee for their help.
