If you pay for a pay ver view movie and it does not work, you deserve a refund.

If you dropped $60 bucks on a digital download of a game, and the game is so fundemantally flawed that you are unable to play DUE TO THE COMPANIES fault (i.e not because the customers computer did not meet requirement, or has bad internet) then you deserve a refund.  EA is refusing to give out refunds, yet many people have YET to play the game since it was released.  There are articles on major gaming websites where the reivewer has yet to even be able to make a city in three days.  How is it NOT accepable to demand a refund when you bought a product have have NO IDEA when you will actually get to use it do to it being broken.  And when the company refuses a refund even though they released a known defective and unployable product (it was just as unplayable in Beta, but they assured us it would be fixed for release...yet same problem still rampant) a charge-back is your only recourse.

And they can be patient and wait to get paid until their product functions properly.  This wasn't about chargebacks.  It was about asking for a refund due to the product not functioning as advertised.  This wasn't a small glitch, but problems that rendered the software non-functional.

If it were a CD/DVD as you stated, let's say a movie, and all their disks were defective I wouldn't want to wait weeks or months for them to send me a new disc at their convenience.  All the while I might add they still would have my money.  Nope, I would ask for a refund and purchase it at a later time when the product worked.

There is nothing self-entitled or nefarious about wanting my due share of a business transaction.

I think a mind wipe so people could play an mmo like it was their first time again, would be easier to build than a new mmo people here would actually like. - DamonVile

You need to read your license agreements, both with Origin and with your cable company. Where SimCity is concerned, you have purchased a "license to use", and it is Origin's position that you will be able to exercise that license in a very short amount of time.

My advise to you is to buy physical copies.  I've already processed my return, printed my return labels, dropped my game in the UPS box this morning, and am eagerly awaiting my credit from Amazon. No EA "bans", no chargebacks, and no problems.

It never ceases to amaze me how so many gamers will go down with the ship in defense of defective or incomplete products but in any other industry it wouldn't be put up with. I have yet to see someone ok with a Big Mac missing the meat patties and told they'll get it later.

No wonder these companies continually walk all over their customers and release the crap they do.

This is why I don't use Steam, Origin, or other services like this.  If I can't get a physical copy or a DRM free digital version I'm not likely to buy it.  That's why I buy my games from GoG.com and my music from Bandcamp.com or Amazon.com.

Ego-centric, where any wrongdoing is the fault of the customer and they weren't burned because they were just more intelligent.

Or obsession with the game, where they like it so much that any critique is viewed as a direct attack on the quality of the game.

Jaded attitude, people just raise their noses to it simply because of the more extremist and stupid actions of people in the past.

Wrong sense of "friendship," some people just think the company is some form of close friend that they must defend.

People honestly believing the company is in the right.

Or, (in)vested interests.

EA Offered a refund to those wanting one due to this fiasco. 

 

The player asked for a refund.

 

The CS rep told him no and that if he tries to dispute this his Origin Account will be banned without a refund (Thus losing all his/her other games). 

 

Going with EA on this one is pretty idiotic. 

 

“if you regrettably feel that we left you down, you can of course request a refund for your order.” Oh... you actually want one? Then never mind, forget what we said and F U! lol...

OMG...the customer didn't go into a rage, call his bank and ask for a chargeback. He didn't take photos of the burger and post them on-line. He just wanted his order to be right so he could eat his lunch...

I find it funny people complain about EA's DRM, but don't complain about Steam. There are many games now that require installing Steam. Although you can play Steam offline I believe. Still, Steam is DRM.

Chargeback isnt a refund, goto a store to return an item and instead of asking for a refund open the register and take the money out yourself. Tell us, what do you think they will do?

You've answered your own question in the same breath... Steam is DRM indeed, but does allow off-line play. This new SimCity DRM is much like D3 and forses you to be on-line whenever you play the game. But... If THEIR servers are down/broken/hacked/DDoS's, you can't play. That's the BIG difference between Steam and D3/SimCity

I think EA should give the guy a refund if he wants one, and not ban his account. Not defending them in any way.

But from all reports its a good game, why not just wait a week and not stress over a $60 problem? I understand being pissed at not being able to play, but this is hardly worth the time or effort involved, and getting your Origin account banned.  Next time you want to buy a game on Origin, just remember this instance and decide to buy or not.

Well people would have if Valve had refused to refund the WarZ buyers after saying to contact them for a refund. But they didn't, and refunded them cleanly.

I think that's the crux of the issue, that EA told them go through support, only for support to acknowledge the statement and then just deny the refund anyway. It's just wasted time and effort, and can only be claimed to not be lie through the most technical and spinned of reasons.

People raged about this exact same thing in Diablo 3 when it launched, but they actually made good on their refunds if you pressed hard enough.  I would like to say everyone following the game knew about the always online DRM, but millions of people trying to cram themselves into the game at the same time (mostly just to play single player!), not to mention how horrible the game was from a design standpoint in the beginning, the refunds were justifiable.

Personally, I can't wait until one of these deals winds up in court: the situation where someone in the past has purchased several titles for either Steam or Origin, decides to charge back a "non-working" title, and then have that customer be denied to access titles they have already paid for. And no, EULAs are not binding until a court says they are. Personally, in such a case, I can not see the company winning, as the customer was presumably doing something allowed by law (a CC chargeback) and was within their rights to do so. I can not see how a court would agree that someone that doing a legal commercial transaction (the chargeback) could be breaching the "contract" with Steam/Origin to the point that it would justify denying that customer access to the products already previously paid for.

While I normally would be behind you... on this one though... it is EA... it is the people that gave us the Star Child... that keep finding new ways to pound their community's... wallets for more money... that gave us Sin to Win and Dead Space 2's "Your mom's gonna hate this game!" ads... sorry but they deserve people nailing them to the wall by their own solid gold egos every time they cock up, they've retarded gaming's advance towards a legitimate art form for years all the while bearing the name "Electronic Arts" though some might claim it to be "Electronic Ass" nowadays.
