These are both very good points.  Also, as far as the cash shop goes....it's like buying a smartphone and then buying apps.  The apps aren't a necesity for the phone to do what's advertised, they are simply added features you can buy if you want them. I have no problem with this business model.

From a credit card perspective or pay pal, I would say that they would likely do a chargeback because it isn't released yet.  I can see from their perspective not giving a refund for something that is used, but as the product hasn't been released I don't see why they would deny the chargeback.  It isn't like they are going to do tons of research themselves.  All he would have to do is say "this product hasn't shipped and there is no release date, so I have no idea when I'll get my product and I am unhappy with that."  Now he would be doing this knowing full well that he is bullsh*tting them, but I don't see why the cc company or paypal wouldn't do a chargback if anet won't give a refund.  

Oh and op, have you done the obvious yet?  Talked to anet?

Game isn't officially launched.  Your case doesn't stand a snowballs chance in hell of winning until the game officially launches and even then, you are full of crap.  I paid for the same "game" and am getting what I was told I would get.  Explain that?  

Cash shop is optional, always is in these games.  There is no mandatory aspect to it, so you have no point there.  City of Heroes bites and has copy pasta'd environments.  Sure you were playing GW2 at all?  I think you are lying.

Actually it has a very good chance.  Paypal generally favors the buyer in these cases.  And since it was a digital purchase, the seller can just disable the account.  So it it's not like he/she bought a lawn mower and caused wear and tear on it.  Also, there are enough people doing the refund via paypal that it will cause red flags.  Further if paypal wants to keep the buyer as a customer they will consider the buyer's points.  Your arguement is merely a product of your wishful thinking and a sense of how you want things to be.

And if Paypal routinely sides with the buyer in situations where they demonstrably got what they paid for, then sellers won't accept Paypal.  People who want to take stuff without paying for it aren't the most profitable customers.

Luckily, there is enough people using paypal to make the company think twice before "banning" paypal. It comes downs to what is more profitable: to have a few people screw you, or lose a lot of people.

This is one of the main reasons why mmo quality is going down.  Due to the hype they don't even need to offer a try before you buy, they have people paying them to try it before they even know when it is actually going to be released.  Does any other industry have a system where you pay the developer of a product money to try the item before the item even officially releases or has a release date?

This isn't meant to be a bash on GW2 in particular they just happen to be the ones doing it this time.  This trend is getting really ugly.

I'll give you some advice play the game and stop QQing. The game is good and nothing like what your trying to make it out to be. Seen your other post saying its like COH which it is not in anyway. The game is awsome and fun. I'm lvl 12 and seen both PVE which is fun and tough. Also the Item shop is in no way pay to win (buy more slots for bags watch out now thats going to let me just kick your butt)so stop trying to lie about the game. I also think your just a big troll and mad because its going to still a lot of players from the game you may like. In my Opinion its one of the best games to come out in a longtime.

you pre-purchased the game, played a bit in the beta and are trying to get your money back?

apart from the fact that it's pre-release and still in beta and therefor under developement,  when you got your e-mail with the code to allow you to play the game did you not read the e-mail properly>?

especialy where it say:

"Online game codes are non-returnable, non-refundable, and can only be used to create or upgrade one game account."

 

i work in sales, and if you open anything that i sold you, then used it and then tried to return it for a refund you'll politly get shown the door. and think anet will do the same

i look this wrecked because i've got GIST.

Here is an example: remember how you got in the head start through TOR preorders? Bioware allowed you to cancel your preorder after headscarf started but before release date and they even actually let you finish the head start. They even came out and officially said you could do this. Several forum goers around here did it.


It's called good customer service. If ncsoft isn't allowing people to cancel their preorders then they are asking for trouble.

It's not fraud to do a credit card charge back. It's called Consumer protection. It's perfectly legal and in fact banks are REQUIRED to provide th service.

It's not as if he got the game, played it for a bit, and then did this. However, even if he did do that it would be perfectly legal and well within his rights. Again, consumer protection.


And @op I would be shocked if there wasn't an official means to cancel your preorder through arenanet. Try that first before attempting a chargeback.

Youre wrong on that point, because he pre-purchased not preordered. Pre-orders are very easy to cancel. Go to gamestop/bestbuy and tell them you want to cancel. Prepurchase...not so much. In fact we didn't even purchase the game itself, we purchased a product key. The game is readily available on the interwebs. Anyone can download it...even people who havent bought it yet. You will find it's quite impossible to return a product key that has been used already.

And as has been mentioned before...the game is still in beta. No release date in sight.

On the note of purchasing a product key..he doesn't even own his own parts account. If you ever get a chance look at the EULA that you accept when you log in. Look at the EULA for any MMO. The characters and accounts you make are all property of either Ncsoft or Arenanet. Same thing with Aion, WoW, AoC....the only thing you own is your personal information attatched to the account. How do you think they are allowed to permanently ban people from servers and from the game entirely.

So he may get a refund but it's likely that Ncsoft will never deal with him again....IF he even gets a refund, which is highly...highly....highly unlikely.

From your perspective, people are paying to try the game before they buy it, and it's a nasty trend. What trend? Where else is this happening?

 

ArenaNet is doing it, and it's working for the better. Soo... I don't understand your point other than to cause tension. There is nothing bad coming out of this at all. Even for a beta, the game is amazing already. Everyone who paid is going to get a copy of the game. 

 

As far as what other industry does this? Well sports for instance... Movies.. You can pre-purchase tickets before you ever know whether or not your team is going to win or the movies even going to be any good. It's not an uncommon practice the MMO community has just been spoiled by the FtP market and ArenaNet is changing things and people don't like it. Ride the wave dude, they'll either fail or succeed and fromt he looks of it, it's no where near a failure.

apart from the fact that it's pre-release and still in beta and therefor under developement,  when you got your e-mail with the code to allow you to play the game did you not read the e-mail properly>?

especialy where it say:

i work in sales, and if you open anything that i sold you, then used it and then tried to return it for a refund you'll politly get shown the door. and think anet will do the same

Most retail items outside of the entertainment industry can be returned after use if the customer is not satisfied.  Heck, half the time I return something I'm not even asked why I'm returning it.  The only time I've ever been hasseled is returning a blu-ray player that I had thrown away the styrophome (sp?).  They charged me a 10$ restocking fee and that was that.  Most states even have laws dealing with contracts that allow the signee to back out within 3 days.
