Stockholms tingsrätt gave mojang right to have a game called "Scrolls" today. Bethesda were suing them and saying it was too close to "The elder scrolls" but the court thought it was rubbish. Sounds like Bethesda like suing people, far from the first company they sue. They also lost the right for Fallout online to Black isle last time. |

It's disappointing that they are taking the litigation route. It's promising that the Minecraft developer won. It would have been cooler if they duked it out in a game. Join the League For Gamers. |

Are there any games using the word "elder" that they can sue? Or using "The", for that matter? |

Would have been cooler if they played Quake, but oh well.
It looks like bethesda just went down a "notch" in respect. =p |

This was the preliminary injunction, not the actual case itself - essentially the court's decision over what the default situation should be while the case is argued out over the months or years ahead. It is not the end of the fight, it was just the roll for initiative at the start of the fight. |

Too many people joking when they have no idea what happened and ofc support Notch as the indie face, cult icon of PC gaming (I mean if you don't support Notch or Valve then what kind of PC gamer you are, right..) |

Originally posted by Robsolf I'm not sure if this information is correct, but I believe Peter North is going to sue Bethesda because apparantly one of the Dragon shouts allows you to disable a dragon in mid-air from behind, it is based on one of the positions he invented, and it's called the Sky-Rim. |

Look I might get flamed for this, and maybe I should, but I sort of supported Bethesda's descision to sue here.
Mojang is making a fantasy game and of all the names they could of called it, they chose "Scrolls". I never did understand why they couldnt simply change the name to any number of other things. Like "Tomes" or whatever.
I mean what else could you call it. Not....Elder Scrolls.....oh I know! Younger Scrolls! Yeeea thats it. And they may as well have. It was done in bad taste in my opinion. It might not have been intentional, but if I were developing a game and called it Scrolls and Bethesda came to me saying it was a problem Id probably say, " Oh....yea....okay. Guys it wasnt intentional. But I can see why you'd be concerned. We'll just change the name. No need to drag courts into it. " And Im sure Bethesda would have totally agreed and shook hands.
Im actually kind of sorry Bethesda lost the case. And its not because Im a Bethesda fan boy. Its just I can honestly see where they were coming from with this lawsuit. I cant say if Mojang did this intentionally or not. But it wouldnt surprise me at all if they did. "Hey Elder Scrolls is popular. We could just call ours Scrolls! Yeeeea. " There's no way of knowing thats the case.

Originally posted by Corehaven You may want to swallow your support of Bethesda, because Mojang did in fact offer to change the name of the game. Bethesda however, continued to sue them. |

Originally posted by Corehaven The point is Notch tried to trademark "Scrolls" which ofc infringes with the already existing "The Elder Scrolls" trademark which is why Bethesda lawyers got all up in arms. |

I like Bethesda and all. But this was just stupid. Hasn't every Elder Scrolls game come with another title like Oblivion? So no, a game called "Scrolls" can't really be confused with it. Course I would also think that an Ipad with a big fat power button couldn't be confused with a tablet that has not buttons. |

They really offered to change the name? Well then if thats the case Im more than glad Bethesda lost. Thats just being stubborn right there. I guess if thats really true Bethesday figured they'd make an example of them. Which is a little too sleazy for my taste. |

Originally posted by Alot Not to play devil's advocate here but I read an interesting article somewhere else about this case. The reason for Bethesda suing was to basicaly protect their trademark. They didn't aim to win or lose, they simply had to sue to protect their trademark so they won't lose it or otherwise someone might make a game called The Eldest Scroll of Skywind and they won't be able to do jack shit about it. ............................................................................................................... |

"I just saw this: http://kotaku.com/5846111/mojang-v-bethesda-or-i-hate-it-when-mommy-and-daddy-fight I feel the need to clarify a couple of things: We realized we should apply for the trademark “Minecraft” to protect our brand. When doing so, we also sent in an application for “Scrolls”. When Bethesda contacted us, we offered both to change the name to “Scrolls: <some subtitle>” and to give up the trademark. They refused on both counts. Whatever reason they have for suing us, it’s not a fear of us having a trademark on the word “Scrolls”, as we’ve offered to give that up." |

Well this turned out exactly how it should have. Hey Bethesda maybe you should have accepted that Quake offer... I honestly don't see how Scrolls is close to The Elder Scrolls other then they both have the word Scrolls big fkin deal. |
