Good Grief, that's all we need!  Luckily he popped his clogs before you put that little bug in his ear!  Also, I don't think you can actually legally shoot trespassers even in the US.  There have people who have gone to prison for shooting a trespasser.  I'm pretty sure there has to be some sort of threat.  If you shoot someone for picking your apples, you could go to prison.  On a happier note, though - if the person you shoot lives, at least he'll be sorry he touched ever your fruit!

Sure you can. Ask any cop here in Cali and they'll tell you the thing that keeps you from going to jail is the person being on your property ( this means within your fenceline ) and the person presenting a clear and present danger to yourself or your family.

To make it simple, 1. ) make sure you taunt the bastard into your yard (inside the house is even better) and 2. ) make sure you have a spare butcher knife to throw down beside his hand after you're done.

Here in Florida we've improved on the old 'Castle Doctrine' (where you have the right to protect your property if threatened) and extended it with the new "Stand your ground" law.

It used to be that if we were away from home and were threatened, we were obligated to try and avoid trouble by attempting to leave the area.

But now, we're allowed to stand tall, and if we are still threatened, we can 'defend' ourselves.

Raises all sorts of ethical questions though, and sadly real people get killed by these two laws.

My daughter had an ex boyfriend who for some reason went on someone's property and "threatened" him somehow, and at 24 years old, ended up dead. (no, he didn't have a weapon or anything, but he was a big son of a b...)

Yeah, maybe you could say he deserved it, but I knew the kid pretty well, and its a shame he's dead regardless of the situation.

But back on topic.  (or this thread might get locked).

Many threads get locked for violating the rules.  But lately I've seen threads shut down with no violation, but they seem to be repetitive trolls of the same tired old subjects, and I think the mods are a bit tired of the lack of new material, so they shut them down.

Actually there are over 14 states that have a law that protects someone who uses deadly force against a threat on their family/property.

In NH we have a law that allows us some of that. If someone were to break into our home and attack us and our defense ended in their death you might be OK. If you shot them and it was determined that they were in the process of fleeing (say ya shot em in the back) its murder.

The one law I like up here is one that deals with shop keepers rights. We actually have a law that allows you to use any force needed to subdue a shop lifter (granted you cant kill them, but a few broken bones is OK) so long as they attempted to resist.

But back on topic, yeah I think the mods are just locking posts because they see them as being started with the intent of being nothing more than a troll/flame war.

There are 3 types of people in the world.

We have it down to a science here in Texas.  If you own dogs (big, loud dogs), anyone who breaks into your house is obviously not threatened by confrontation and it is your legal right to shoot them dead without warning.

 

But make sure they're dead. If they live to testify things get sticky.
