The trademark for the Game itself though still says live. Its the trademarks for everything else that was let go. Wonder if it could be part of some publishing deal. |

Hi, I looked at this in detail not long ago. There was a previous fantasy computer game called "Dark Fall" that was published in the late 1990s I think. Obviously that would mean it would be a trademark violation for another company to make a fantasy computer game called "Darkfall". So they got their applications rejected right away. It is strange, but the people at Darkfall thought they could get around this for a while just by working the beaureacracy correctly. That never happened, but what did happen is they eventually negotiated with the original trademark holder for "Dark Fall" fantasy video game, and got them to waive their rights to the trademark and allow Aventurine to [basically] take over that registration without protest. So, basically Aventurine bought the trademark rights from the ones who already owned that trademark, because it seems unlikely that the company just waived their rights away for free. The one and only. |

The fact is that they only have 1 live application still in the system which is suspended and has been in troubles and suspended since 2003. And that is the one that gives them legal rights to use "Darkfall" as a computer game commercially within the USA. Technically you don't need a trademark. But the fact that someone already has a copyright on this name it would be a completely idiotic thing to release the game with that name. They could get sued instantly even if the current owners allow them to use it. They could at anytime change their minds.. The fact is -- the trademark atorneys job is to make sure 100% without a shadow of a doubt that there could never be any legal problems from a trademark they allow through. If there's even a tiny risk they will never allow it through. "Darkfall" is just completely tainted with potential problems and that's why it still is not through since 2003. |
