Dark and Light game developer NPCube dismissed and convicted by French Court

France (SANEPR.com) March 18, 2008 -- On April 27, 2007 VWORLD filed a lawsuit against Reunionese developer NPCube, and jointly against Mauritian publisher Farlan Entertainment and Mr Cesar Jacquet, on the grounds of software and technology counterfeit, non-respect of the right to being credited and paternity, unfair competition and parasitism.

NPCube then sued VWORLD before the Commercial Court of Clermont-Ferrand during September 2007 on the grounds of unfair competition and damage to NPCube's reputation.
NPCube was accusing VWORLD of being liable for the difficulties it faced in the development and commercialization of its Dark and Light MMORPG. NPCube was also accusing VWORLD of having interfered with and damaged both partnerships signed between NPCube and the University of Reunion Island, within the framework of the first phase of the E-Campus project, which was financed by European structural funds (ERDF), and between NPCube and the Chinese company SnailGame in order to carry out the development of the Asian version of the Dark and Light MMORPG.
NPCube also claimed it was using a technology called SCAPER for the development of the seamless terrain client part of its Mafate game engine, used in Dark and Light, the Asian version of Dark and Light and E-Campus.
NPCube was demanding €710,000 of damages.



On March 13, 2008, NPCube has been entirely dismissed of all its claims by the Commercial Court of Clermont-Ferrand, which ruled that the various failures encountered by NPCube were by no means imputable to VWORLD. The Court also ruled that the Mafate game engine was making use of the V-world technology, rebranded VWorldTerrain in 2004, and not of a « SCAPER technology».

NPCube is convicted and fined €50,000 in damages to VWORLD.

nah, this is just the crap Farlan threw in there to muddy the waters of the main lawsuit. The main is still ongoing with a court date sometime in Oct.

The original lawsuit from VWORLD against Farlan is still ongoing to be heard sometime in Oct. of this year.

Farlans frivolous lawsuit however was heard on March 13th this year and this is the official release of the news of what happened. The court threw out Farlans claims and fined them to boot!

If you mean Farlan posted False Information, then you would be correct. This proves it, Farlans lies and false claims are coming to an end with a legal penalty,,,fining them for the trouble they are causing VWORLD ! :)

Nope, this is the next to last nail in DnLs' coffin.

Now that farlan/NPcubes' lawsuit against VWorld has been dismissed AND the court has ruled that DnL does indeed make use of the Mafate engine and not an engine of NPcube design (SCAPER), the outcome of the lawsuit of VWorld against farlan/NPcube is essentially clear. When the final suit is ruled upon, then _Pix_  will get the technology he created removed from DnL. Which basically means DnL will be a bunch of art assets with no engine or code to run them. So the only way DnL will continue afterwards, will be IF Farlan can come up with a new engine to run it on, as well as new code to bring it all together.

And you might as well say goodbye to the  "immense world" of DnL, because there's no other engine that will allow the landmass and features of _Pix_s'  tech made by anyone who would touch DnL with a 10' pole. And whatever engine DnL ends up with will either be a cookie cutter asian grinder model 10 years out of date provided by Snailgames ( if they don't decide to just dump it when they realize the work they put into DnL is erased once VWorld tech is removed ), or some low-grade c-list engine made by noone in particular. Because there is no way any established, high-end company producing game engines is going to allow their products anywhere near DnL after all that has taken place. And finding high quality programmers will be virtually impossible for Farlan as well, as most real programmers like to be paid.

Aye, the court agreed with the evidence and found the use of his tech in their game. The court agreed they are in fact harassing VWORLD.  Once already established in a court of law, Farlan has no defense whatsoever.

And the cards come tumbling down.......

So, to try to pull any more shenanigans with the main case in October would be ...welp...a continued course of the final nail to Farlan.

All of their lies are being proven in a court of law and its hitting them in the pocket yet again. By the time this gets to the main one in October, it will be an already done deal and an easy one for the courts to decide.

Like I stated earlier, Farlans house of cards, missing the aces in the first place, has begun its self-destruction for the world to see.

It appears their facade cracked, crumbled and slipped away at the first battle round, very much like the armor in the game (but hey! you can fly for hours and see...well...and see...landscape! You can even fly underwater!)  LOL guess the first round goes to the level 1 pigs who can gank a toon 60x higher than them!

Aye, will be interesting to see what they try to come up with, or try to pull in the ensuing months. Fanbois are already trying to shill the "chinese version". I say who the heck cares anymore! Except Snailgames US/EU markets as Zorvan pointed out in another thread.

Well that  would explain why C. Jacquet won't hold his word on publishing all Court's decisions, since the Court decision of March 13th quite clearly ratifies these facts: 

- I am the inventor of VWorldTerrain technology, and VWORLD, after CPUSoftware (1997-2003), is the only company in charge of licensing it. 
- NPCube uses VWorldTerrain technology (and no other, whatever they try to call it) for the development of its Mafate engine and its Dark and Light product, therefore of course the SnailGame present version.      

This implies automatically SnailGame now develops a product which makes use of a technology which does not belong to it nor its NPCube/Farlan partners, and of which they all don't seem to have a sufficient technical understanding, judging by the fact they felt it necessary to use 2005 VWorldTerrain video sequences, instead of showing their recent in-game real-time production, to make the present promotion of the game, which is still to come soon, although their deal over DnL is now almost three years old.
