Seriously, I have no beef with Mr. Appleton.  I'm not interested in his game and I'm not mad that some people might find his game and ideas a lot of fun.  We each have different tastes and likes and that makes the world a more interesting place.  What I do have an issue with is people who refuse to accept the truth.  Both you and Mr. Appleton fall into this category and here is why.

 

1. Mr. Appleton clearly has some issues keeping his emotions under control and making knee-jerk reactionary business decisions.  That is not the kind of guy I want leading the design of my next MMO and sadly, he does not get it.  In his world, it is sound business practice to buy assets and change directions as often as he wishes without doing any sort of plan or research.  This has clearly been shown in his game engine flip-flops and his price-model changes.  He should have hired a real lead designer with some experience and he should have planned his project out better.  The fact that he had to change engines, change price model AND ask for more money clearly shows his lack of business sense.

 

2. For anyone to think that getting a message from Mr. Appleton that mentions illegal actions and links to legal action taken against people on the internet and NOT think that it could IN ANY WAY be taken as a threat of legal action is absolutely ridiculous.  Blind fanboism is just as bad for todays gaming forums as the hatred being spewed. 

 

I dont agree with anyone saying Mr. Appleton is a thief or a scam artist and I honestly believe he is trying to design and produce a game that our industry really needs.  I just dont believe he has the business sense or ability to pull it off and create a MMO that scores above 70 when PCGamer reviews it.  Because of that, I wont be donating to his dream but I do understand why some people would and I hold them no ill will.  I just feel bad that they wont be getting the game they think.  This all happened a few years back when Henrik started Mortal Online.  Great idea, lots of hype and potential, but in the end, truely sad business ethics and poor management could not be overcome.  History is repeating itself.

This is definitely the most entertaining thread I have seen in awhile on mmorpg.com. It blows my mind why the Greed Mongers Devs keep posting on this site. If you don't want negative criticism, stop posting, it's as simple as that.


The GM devs try so hard at trolling there has to be a reason behind it. They just smell of Scam artists, because nobody can be this incompetent, can they ?

What kills me is that MMORPG.com capitulated so easily to a threat such as a frivolous lawsuit.   This sets a precedent.   That pecedent being, that if any developer or publisher doesn't like what is being said about their game - they can just threaten MMORPG.com with a lawsuit(frivolous at that) and have comments, articles, blogs or anything related to a game removed.  

MMORPG.com is a privately owned business, and doesn't fall under the laws of freedom of speech(in that they can moderate what people say), but if a person post something, MMORPG.com cannot be held liable - only the party that made the comment can.   Even in such a case, as has been brought up here were the party says he was slandered by commenters and it is hurting his business - he doesn't have a business as of yet in the gaming industry.    He has no product.   So therefore he has no grounds to sue under any reason that is currently on the law books.   If anything MMORPG.com should re-instate the forums for the game and information about the game, include warnings about the state of the game and the current issues of what has transpired - because

 

(17 USC § 107 - Limitations on exclusive rights: Fair use) allows for it.

 

If Jason wishes to persue it in a court of law, let him, and when he loses(and he will), MMORPG.com should counter sue for trying to squelch this companies first admendments rights(and under fair use copyright laws) - not the rights of the posters that use the forum, but their own rights under the same admendment that Jason seems to want to deny.  Then have Jason, pay court cost, and any damages brought to MMORPG.com because of Jason and his need try to squelch people from discussing his game.

If this is going to be the norm from now on, will we have to have our post, blogs and articles cleared for publication because some publisher of game developers don't like what we have to say?

Next thing you know he will be xzying "I hear you are a traveling man- How Old is your Grandmother" and throwing out virtual hanmdshakes. (some will get the reference- Others will say WTF?)

Someone who actually is a Freemason wouldn't state or even imply that the organisation would act against anyone.

If this is going to be the norm from now on, will we have to have our post, blogs and articles cleared for publication because some publisher of game developers don't like what we have to say?

there was a old women who sued her neibers for makeing to much noise playing basket ball in the middle of the day and made a few hundred k in texas, you would be suprised what can win in a suit case these days the states are sue happy, like i said it isnt worth the timee, even a failed lawsuit has expense to both sides, and requires effect.

honestly with a crap game like this one it was just simpler to dump the forums then listen to his whineing, it would have been diffrent if it had been a major subject, or game company but for a small fry

it just not worth the bother of it.

Well on "fair use" alone, MMORPG.com can have a section on his game and there is nothing Jason can do.   With that said, what worries me as a regular poster and somewhat frequent blogger, will MMORPG.com start pulling blogs, articles and comments just because some developer or publisher doesn't like what is being said about their game?  I mean they did it for Jason, why stop there - do it for SOE, AE, whoever.

This is what concerns me.

I agree with the part where this was more of a headache than it was worth. Will MMORPG.com bend over and constantly take this from developers? It's possible I guess. who knows, i only actully started posting here as a way to vent on my frusteration in the F2p vs P2P war.

after i got that out of my system ( and kinda sick of the whole argument) i stuck around for the bits of info you can dredge out of all the bul, oh and the entertainment, the argument here are just silly sometimes.

I don't think that precedent will be problematic.  Apparently it has been site policy to delist a game if the developer requests it for a while; that policy game into play when World War II Online was delisted.  Delisting a game does not mean that the game can no longer be discussed; see this thread, for example.

People who have never heard of your game will never buy it.  Being listed on this site means that more people find out about your game than would otherwise.  That basically constitutes free advertising for your game.  Game companies usually benefit from having their game listed here.

It gets better. I just discovered Mr. Appleton has sent me a message on Facebook with similar content to what he sent to MMORPG.com.

He warns me not to share this information which of cause is ridiculous. What this joker does not know is that his little disclaimer is complete rubbish.

An email disclaimer does not create a contract with an unintended recipient. Contracts require a “meeting of the minds” – they cannot be dictated unilaterally.

I feel bad for the backers who are watching their $90,000+ pledges go nowhere. If only they could get them back and pledge to CU, which actually has a proven developer, not some guy who used to run MMA fights and decided to just make an MMORPG one day, like it was no big deal.

At least this horror show is providing some entertainment, but again, sucks for the backers.
