Originally posted by Kyleran This. Unfortunately, in the US anyone with a lot of money can make someone very miserable and/or broke with lawsuits. In the end, this won't even put a dent into Blizzard and will change nothing. Though it will pay for a few lawyers next trip to Tahiti. |

It will be like a bunch of goldfishes and a medium sized shark taking on a bunch of barracudas with lazers... It is a good thing for the goldies that the Barracudas have a big spending account.
It is a quick moneygrab and they will be payed good and well for it. No company actually want to test the outer limits of a EULA ot ToS.
This have been a good conversation |

Not everyone has endless amounts of time. Also, just because they are pissed off about D3 being down a lot (I saw posts about 3 days/week downtime on average for Asia servers posted on EU battlenet forums), doesn't mean they have to hate Blizzard. If I were reliant on an internet café and had those kinds of downtimes for a new game I just bought, I would ask for a refund and would complain to a consumer group if I didn't get it. That doesn't mean I wouldn't continue playing WoW or SC2...

I'm not playing Diablo III so this doesn't affect me at all, but I can't help but smile just a bit at the thought of anyone kicking Blizzard where it hurts.

Originally posted by Psychow An hour? Mate their's an 8 hour downtime every couple of days on the EU servers. It still happens but no where near as randomly and often as release. One of their downtimes is going on right now infact, that's why I'm on here. Downtimes + online only = Can't play the game. It's bullshit, why are you defending them? If they make a game online only, they should upgrade their servers, they have enough money to do so!!
EDIT: Also sorry about the baseball comment in that case, I honestly wouldn't know about American sports. All we know here is football (for me atleast and the vast majority of brits). _________ Watching: Darkfall: Unholy Wars, Elder Scrolls Online, ArcheAge, Camelot Unchained, Bless, Black Desert Online, Lineage Eternal, MU 2. Always hating on instances in MMOs! Open worlds, open PvP, territory control and housing please. More persistence, more fun. |

Originally posted by Adam1902 I wouldn't bother arguing with this guy. Some people don't understand the concept of "principle" and holding people "accountable". Plus, their experience is the definitive experience that EVERYONE has. If it's anything different then you're an "Idiots...".
We paid for a game and a service. They didn't deliver on their service for many people. They need to be held accountable. This wouldn't fly with any other industry. If you bought a movie and could only watch it online, but the server kept going down, you'd be pretty pissed eh? |

Originally posted by Psychow Have you seen footage of a Korean cyber cafe during Diablo 3 launch? With the social nature of gaming over there, it was the equivalent of going to a bar and being charged for your regular drinks, but being served water instead. Error: 37. Signature not found. From what I understand, the Koreans were denied refunds. The only people who were able to get refunds were people in the EU and NA. So yeah, they were kind of pissed about that in the first place.
Also, Korea takes gaming very seriously. The government is heavily involved in gaming over there. It's got nothing to do with being corrupt or some kind of cash grab.

On topic: There has been far too many upsets over the server stability of Diablo 3. If the servers weren't ready, they should have held back release. Just my two cents. The Deep Web is sca-ry. |

Good luck. Signing an agreement might be binding but that does not make a company automatically immune from liability, consmers still have rights regsrdless of what's agreed to etc. so they might try. I'm glad i got out at the beginning, never looked back. ![]() |

Originally posted by MurlockDance The cyber cafe buys a multi-use license from Blizzard. The customer then pays the cyber cafe for time played. The customer gets his battle net account for free. They do not pay for the game just the time used. They rent the game they don't buy it. It's a different business model. The owners of the cyber cafes are suing not the players. It's becoming more common for people to buy the game in Korea so they can play from home instead f at cafes. Those people are not suing Blizzard. Most of the current downtimes are due to hotfixes and in the U.S. adding things like the RMAH to the servers. It has nothing to do with bandwidth or quality of the servers. The servers themselves are quite good and the same as the servers for the rest of the battlenet games. At launch they were just flat out swamped.

South Korea forces Blizzard to give Diablo III refunds http://massively.joystiq.com/2012/06/21/south-korea-forces-blizzard-to-give-diablo-iii-refunds/ Many South Korean players were angered due to massive server crashes and high latency while playing Diablo III. The Wall Street Journal reports that 66% of Diablo III online traffic in Asia comes from the country. EQNext press http://EQ3Wire.com EQ2: Freeport server |
