What it told me was: gaming is now considered to be a form of art in the eyes of the American supreme court  and that one shouldn't conciously attempt to make clones.

That's the government, not the surpreme court. The supreme court ruled in favor of the gaming industry during the last case of "Government versus 'Violent Games' ".

Ahh, the whole Governor Schwarzenneger thing and violent games.  Funny especially coming from a guy that made his career and fame for violent movie roles and massive body counts.
