Lets look at this a different way. 

There is a legal requirement that the account holder must be 13 or over. 

Just like it is a legal requirement to be over 21(in USA) to drink alcohol

If you went into a bar and said to the barman "Hey, Im 16, can I have a beer" he is gonna throw you out. If you then produce ID showing that you are 21, he will let you in(If you are lucky! I would bar you for being a dumbass!)

All the guy has to do is prove he is over 13 via the appeals process and he is sorted.

Anyone that thinks he shouldnt be banned, needs to realise that Bioware has no way of proving that he is 13 or over. Maybe they should have temp banned him until he proved his age, but the same process still applies. You think Bioware should ignore the law and their own TOS?

I seriously expect that he did something more than this to get banned though. Its a classic case of someone doing something they know is wrong, then whining all over the forums saying "I got banned, I did nothing wrong". Just like the Ilum chest farming...

Bioware are NOT the law and thefore can not write their own laws.

As much as you might like to believe it, Biowares TOS is NOT Law and accepting it does not bind you to anything "legally". That would have to be decided by a court of law NOT Bioware.

Most TOS would never stand up in court.

I'm not even commenting on the ban. I think the ban is alittle silly but I also know rules are rules. As to me being ignorant I think you need to look in the mirror. If you dont think companies actually check social media sites you really have no clue what goes on when hiring employees. Maybe not for your typical factory or office job. But it DOES happen. There are even positions that temporary services check things like that. How do I know? Because that was my job for a short period of time. Yup, thats right. I got PAID to go online, type in a persons name and then fill out a report on what I found. Again, this generally only happens for jobs where a person is in the public representing the the company.

As to the outback thing I'm with you. One bad experience will not keep me from going to outback again. However not everyone is like you and me. Just because WE would go back doesnt mean the other 20 people that waitress pissed off would go back. I'll use my parents as an example. They where treated horribly by someone at best buy a few years back. They have not and will never go back to Best Buy again. Just like there are people out there who will never buy another product that has EA attached to it in any way, even if they are just the publisher, simply because they backed SOPA.
