 If you are not in beta, did not sign a NDA and say you are in beta and make up lies about the game does that mean you are virtually breaking the NDA from a Fantasy perspective. Since if you fantasize that you are in the game and have signed a fantasy NDA are you breaking the NDA? Plus the resources involved in reporting the NDA breaker to the company and they search for your information somehow to find out if you are indeed in beta and breaking the NDA but you happen to create a profile of someone you know is in beta by peeking into his window at night and seeing him play the beta and since he would not let you in to play you are setting him up. 

So are you breaking the NDA ? Whats going on in this situation.

What's the point of this thread?  Are you planning to hype/trash STO beta and claim you are in beta?

I suspect if you make up stuff claiming you are in beta, that you likely would be treated as an actual NDA breaker on these forums, i.e. banned.

No it could actually be worse than breaking an NDA.... I don't think I've honestly seen anything more than being kicked out of a beta for breaking NDA.

 

At least I don't remember anything major..

 

However, if you claimed you were in beta.. then gave "false information" that could be seen as detrimental to that product..  When you consider the amount of money it costs to bring an MMO to market.. and it can be argued that the false information you claimed came from the prodcut had a negative effect ...

 

You could actually end up in court...

I'm in beta and this game sucks and I also killed Michael Jackson.

You are not bound to the terms of any agreement that you were not a party to (i.e. signed). For example if your freind Joe was in Beta and signed an NDA and you happaned to be over Joe's house one day when he was playing and happaned to notice some things about the game when he was playing. You could post that information publicaly and would NOT be in breach of NDA.... because YOU had no NDA with that company. The site could still BAN you or remove your comments because forum owners can pretty much follow any rules they like (or not).

The company could not however take you to Court for breach of contract (well they could, but it would be thrown out right away) ...because you signed no contract with them. They could maybe try to get you for "trade secrets" or something like that but not for breach of an agreement that you weren't party to.

You ARE responsible for any public statements you make that could be defametory to a person or company/organization. They could potentialy sue you for defamation for something like that. However, the entity that filed suit against you would have to prove that your statements were false, harmful and that were offered as FACT rather then a OPINION.

You could say something like "In my OPINION, X blows chunks."  Even if your opinion was based on nothing more then something that existed only in your own head. However if you said something like "X will not load unless you have 2 Gigs of RAM free" that could be taken as a statement of FACT rather then opinion and you could be held responsible for it.

On the other hand, if what you stated happens to be trurthfull (and you could show it as such).... your pretty much safe... no matter how damaging it is ....and regardless of whether it was offered as fact. Truth is pretty much considered an absolute defence.

At least that's the way it's supposed to work in the US. Not sure about the rest of the world.
