??!! Compare the logo and color to the Aion logo, look at the wing points (Elyos / Asmodian) and the song is called "Into the Abyss" (Abyss is the PVP zone of Aion) , CD (I think) is from 1999....from: www.aionsource.com/forum/chitchat/49905-aion.html
Sue? |

haha give me a break
God should sue for his rights too.
Copyright laws are such a joke in the modern age. |

I think the similarities are to close to call coincidence. As for the band needing to sue... NCSoft could have bought the rights.. I have no idea. |

I'd say coincidence.. mainly because Aion was already a deity's name (which religion I can't remember) and if it's an emo / punk rock group everything else is classic to the genre of music.
Also I don't think you could build a copyright lawsuit even if they did copy it intentionally. A small borderline unknown polish band is going to take on a large international gaming company... it'd be 2015 before any decision was made.
Add in international copyright laws already being a joke. Kind of pointless even to bring up even if you were right (tinfoil hat). Besides they may have just shelled out a few thousand dollars and bought the rights. |

I don't think you know how this works. The material is owned by a label, in this case Crash Music Inc., they're not that small and have deals with EMI it says. The band wouldn't sue, the label would. The international rights are no issue to sue either, since Crash Music is from the US and the game is distributed...in the US.

Has to go a little further than that. It has to be a copywrite that specifically refers to use of the name in video games. Aion isn't a made up word it's used by several companied for various purposes. "Any sufficiently advanced incompetence is indistinguishable from malice." ~Greys Law |

Yeah because there's no blatant copyright infringement going on currently that's just stuck in legal limbo. Also have you considered things like Vanguard? That's also a financial company.... again you can't sue because they used the same name... it would have to be another band for any real merit. Put the tinfoil hats away. |

Are you for real? This isn't just the name, look at the wings and compare them to the Elyos / Asmodian, look at the design of the gate and compare it to the logo, look at the colour of the logo, look at the name of the songs....This is all copied. It falls under prior art and you bet you can sue for that. |

Oh yeah cause winged statues are only used on that CD cover and on characters in Aion... wouldn't have *anything* to do with it being a punk band and the polish being largely christian(all sub sets included)....
No dice. Angels/Demons are heavily used.. you'd have no case. The only arguement is the name and again I use the Vanguard example. You've got nothing.
PS- What about the balaur? |

Angels and demons are religious as is the name Aion. If you didn't know Kronos(sp?) was referred to as Aion. Interesting coincidence at best. Neat find though I forgot about that band. And they sound more like speed metal than punk. |

Ok try to refute the similarites then, are you saying the design, name, logo, wings design, gate design, Abyss name, Aion name, just happen to be the same? Even the tree design is the same. That's a pretty small chance bud. |

But tell em apart of the name what other stuff on that cd cover has aion copied? Statues/pictures of angels and demons can be found practically every were same for the gate. For Abyss part if you type in google or whatever search engine "abyss means" some sites will tell you some descriptions: Abyss Meaning and Definition 1. (n.) A bottomless or unfathomed depth, gulf, or chasm; hence, any deep, immeasurable, and, specifically, hell, or the bottomless pit. The cover seems like an entrance to a cemetry imo.

It all depends Does the band pronounce their name "Eye-on" or "Aye-on"? |
