Nice catch Aleos, didn't even realise that it was from Fallen Earth maybe thats why it hasn't been taken care of yet. I'm not in the FE beta, which means I never signed an NDA. The avatar is cropped from a larger image found while searching Google.
Doesn't really matter, if the image is from the Fallen Earth beta released by someone without the authority to do so they have to right to make you take it off.
Sure, if they ask, I'll take it off. But not before I demand that mmorpg.com remove all player submitted screenshots in the secreenshot section under Fallen Earth on this site. |

I do not see how the makers of MO can say they have an NDA when people have purchased a product. I feel once a purchase has transpired and and money exchanges owners for a goods or service then that goods or service is open game to being reviewed or discussed. Considering how much people payed to get into the "beta", basically purchasing the game, how can they even think of keeping it under and NDA?

People seriously don't seem to understand that even if you have not signed the NDA you still have the ability to break it by carrying information for something that has broken the NDA. Also im still waiting for you to show me when I said I was in beta.  Damnant quod non intellegunt

Ok I worded it wrong, what I meant from that post was if you carry on information that was presented to you from someone who broke the NDA it is still information obtained against the NDA meaning reposting it can still get you into trouble regardless.
Prime example of this is me saying id post a pic after the NDA was taken off, mmorpg.com had no idea of if I was in beta and signed a NDA but I was still temp banned. Damnant quod non intellegunt

Okay, lets take a hypothetical. Person A is in a beta with an NDA and takes a screenshot. Person A sends the screenshot to Person B, who is not in the beta and did not sign an NDA. Person B posts the shot on mmorpg.com and gets banned. It doesn't matter that Person B didn't technically violate the NDA, from mmorpg.com's point-of-view, because the website wants to support confidentiality agreements for companies under closed beta regardless of where the info comes from. It is sort of like possessing stolen goods, being ignorant that something you have in your possession is stolen is not necessarily an excuse. This is not to say that such bans shouldn't be lifted after a while. |

Agreed, but I doubt all the avatar pics here are "legal" -- say yours, for instance. Where did you get that horse? Did you draw it yourself? If not, did you get the artist's permission to use it? My guess is that 100% of the avatar pics here, unless a photo of the actual person, are "illegal" and in violation of mmorpg.com rules.

Assumptions aren't grounds for a ban. This is what I sent to get myself unbanned. Ok I gotta know how that warrants a ban, its not breaking NDA so what the hell is the problem. Seriously want to know because I believe this is ridiculous. I said Id post a beautiful pic when the NDA is lifted, so what if I said id post a pic just plain ass pic with nothing attached I wouldn't of been banned? This is his response I apologize for the confusion; I have lifted the ban from your account.

The pony is my own, the girl is my rl GF, the grass is my lawn, the troll is my ugly brother, ... only the font is stolen from Funcom / AoC, but it has been distributed freely! Nah, you might be right. But since I am somewhat of a professional artist I know that if you use pieces of existing material artistically and editted in such a thorough way that the result becomes something completely different, it will be regarded 'a piece of art' in court, (at least in a Dutch one). Similar to a collumnist quoting parts of a book. It is rather complex and there is a fair bit of interpretation involved and I'm not sure if my sig would pass the test though it consists of 7 images put together. Plenty of artists use 'ready found' material like that and use it as parts in their own work, though. That doesn't mean mmorpg has to respect that; they could rather want to be safe and sure and get rid of all our sigs and avatars, like you say.

Or they could do what a lot of other forums do: Provide a stock set of images to choose from and disallow the uploading of avatar pics. |
