They'll probably just start selling credits as part of Smedley's bend the customer over marketing strategy.  Remember, Smedley believes the subscription model is dead and paying for in game items is the way of the future.

Problem is, almost every game company that has tried to go after RMT companies either get shot down in court or lose because the company they are going after is some ghost corporation that disappears as soon as legal action is taken. Look how many times someone who was banned for botting/hacking in an MMO found some legal loophole that got them thier accounts back (those who actually took the case to litigation vs those who just opened a new account). The costs of the legal action alone isn't worth it.

But, Blizzard was lucky enough that the guy who created the bot software had a known name, address and recieved money for the sales of his program (where most bot programs were freeware). So he made a profit from the software that was linked to his name. You couldn't ask for anything easier.

Only thing I hope is the courts actually do something about this one, after seeing so many others walk away because of some lame technicality.

RMT is a good strategy for them.  Change the way their success is measured means he won't get fired.  Its pretty much understood that the current crop of SOE subscribers will put up with just about anything they do and they aren't getting new ones.  It only makes sense to squeeze more money out of what they have.  Smed does seem rather skilled at all aspects of the business, except for the whole "what makes a good game" bit of it.
